The defense attorneys for terrorist Luis Posada Carriles, asked the judge who is responsible for conducting the trial, to reject the presentation in court of the evidence of the Cuban terrorist involvement in the bombings of 1997 in Cuba, which killed Italian tourist Fabio Di Celmo.
In a motion filed before Judge Kathleen Cardone, which was accessed by [news agency] EFE, the lawyers argued that the government had violated the court order which required the prosecution to produce, before December 1st of 2009, the evidence obtained in Cuba about the participation of Posada Carriles in the acts [of 1997.]
Now the lawyers try to hang on to a legal technicality to try to eliminate key evidence of the terrorist nature of their client.
According to Posada Carriles' lawyers, prosecutors refused to hand over that evidence and the defense will not have enough time to review the documents for the trial on January 10th in federal court in El Paso, Texas.
Posada Carriles is accused of lying to U.S. immigration authorities. In 2007 he faced trial on these charges in a court in El Paso, but Judge Cardone rejected the charges, arguing that the prosecution acted in bad faith with the terrorist. Posada has lived since then free on the streets of Miami, actively participating in public events and inciting violence.
The strategy of the prosecution has been to delay to infinity the legal frame on the minor charges and to to keep Posada Carriles from carrying out his threat of revealing the details of his experience with the CIA for 25 years, which would lead to being judged harshly for his crimes. (Cubadebate)
